These Terms of Use (“Terms”) govern your access to and use of www.estatehack.com and our software services (collectively, the “Services”), provided by EstateHack (“we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you don’t agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old and a resident of the United States to use our Services. By agreeing to these Terms, you confirm you meet these requirements and have the legal capacity to enter this agreement.

2. Services Overview

EstateHack provides tools to help real estate investors discover, analyze, and manage Section 8 properties. Features include property databases, rental income estimators, tenant management tools, and more. We reserve the right to modify or discontinue any feature with notice, as outlined in Section 12.

3. Account Registration

• Creating an Account: You must register with a valid email and password to access full Services.
• Your Responsibility: Keep your account secure. You’re liable for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use.
• Accuracy: Provide true, current information during registration.

4. Subscription and Payment

• Plans: We offer monthly and annual subscriptions. Details are on our pricing page.
• Billing: You authorize us to charge your payment method per the chosen plan. Fees are non-refundable except as stated in our Refund Policy.
• Auto-Renewal: Subscriptions renew automatically unless canceled via your account or by contacting us.

5. User Conduct

You agree not to:

• Use the Services for illegal purposes or to violate third-party rights.
• Reverse-engineer, copy, or distribute our software or content.
• Abuse the platform (e.g., spamming, hacking, overloading servers).
• Misrepresent your identity or investment intentions.

We may suspend or terminate your account for violations, at our discretion.

6. Intellectual Property

• Our Rights: EstateHack owns all rights to the Services, including software, designs, and content (e.g., property data tools). You’re granted a non-exclusive, revocable license to use them for personal, non-commercial purposes.
• Your Content: Data you upload (e.g., property notes) remains yours. You grant us a license to use it to provide and improve the Services.

7. Third-Party Data

Our Services may include data from public records or third-party providers (e.g., real estate listings). We’re not responsible for its accuracy or availability. Use it at your own risk.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We don’t guarantee:

• Error-free operation or uninterrupted access.
• Specific investment outcomes from using our tools.

To the fullest extent permitted by U.S. law, we disclaim all warranties, express or implied (e.g., merchantability, fitness for purpose).

9. Limitation of Liability

EstateHack isn’t liable for:

• Indirect, incidental, or consequential damages (e.g., lost profits, data loss).
• Decisions you make based on our Services (e.g., property purchases).

Our total liability won’t exceed the fees you paid us in the prior 12 months, or $0 if you paid nothing, per applicable law.

10. Indemnification

You agree to defend and indemnify EstateHack, its affiliates, and employees against claims arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Termination

• By You: Cancel your account anytime via the dashboard or email.
• By Us: We may suspend or terminate your access for breach of Terms, non-payment, or legal reasons, with or without notice.
• Post-Termination: Sections 6, 8-10, and 13 survive termination.

12. Changes to Terms or Services

We may update these Terms or modify the Services. Minor changes take effect immediately upon posting. Significant changes will be notified via email or site announcement 30 days in advance. Continued use after changes means you accept them.

13. Governing Law and Disputes

• Law: These Terms are governed by the laws of Wyoming, USA, without regard to conflict of laws principles.
• Disputes: Any disputes will be resolved in state or federal courts in Wyoming. You waive objections to venue or jurisdiction.
